Letter from the President Editor’s Note The President wrote this letter approximately a month before publication. While the Pandemic circumstances have worsened, the sentiment expressed remains valid.
As I reflect on the last 16 months, I am trying to make sense of this ordeal we have all experienced. Several years ago, I flew to Boston for the memorial service of a relative, Leslie. Leslie was 65 at the time of her death, and her last two years were marked by one debilitating illness after another, increasing incapacity, and hard-to-watch suffering. For the first 63 years of her life, Leslie had been vibrant and fun-loving. She enjoyed throwing parties, and she had a mischievous sense of humor. She loved playing golf and going to the beach. At her memorial service, I spoke in Leslie’s memory. I expressed my belief, developed over many years, that we have the ability to choose how we remember people. I said that I chose to remember the vibrant, fun, mischievous Leslie, rather than the sick, incapacitated, suffering Leslie. Of course, I acknowledged the agony she had endured in her last years. But I chose not to let those last years dominate my memories of her, to define Leslie as a person. I chose to focus on the positive impact of Leslie’s life. As we emerge from the Pandemic, I feel the same way. Many of us have had to endure tremendous suffering and hardship. Some have lost loved ones. Others have experienced life-threatening medical issues. Our practices suffered. We were prevented from seeing families and friends. We missed holidays, graduations, and celebrations. Many of us feel as if we put our lives on hold for over a year. I even know one young man whose job at Buffalo General Hospital involved holding the iPad as families who were not permitted to visit said goodbye to their dying loved ones. Instead of recounting these months of deprivation, however, I choose to focus on how we’ve responded to the Pandemic. I choose to praise our collective resilience. I choose to recognize the medical advances — perhaps especially the vaccines — that have enabled us to emerge. I choose to honor the frontline medical workers and care givers. Mostly, I choose to celebrate those unsung heroes among us who — day-by-day, step-by-step — just kept moving forward. I think of the people who arranged for us to work remotely, or should I say to work well remotely. I think of the people who kept our businesses, including the courts and government offices, open. I think of our young parents who worked full-time remotely, and who also essentially educated their children. I have a close colleague who was getting up every morning at 4:00 to work for several hours before her elementary school aged daughters rose. She would then
work for several hours again at night, after a full day of teaching and parenting, and after she tucked in the girls. I know that

her legal work did not suffer. And, she reports that the year with her children presented an opportunity for bonding she would never trade. In particular, we owe our thanks to two people who kept the Bar Association of Erie County running during this chaos, Executive Director Anne Noble and President Oliver Young. Their quiet, steady leadership enabled the Bar Association not just to survive but also to thrive during the Pandemic. My generation had never experienced anything resembling a Pandemic. I remember the weekly casualty counts reported on the national news during the Vietnam War. Obviously, I remember September 11 and its aftermath. The Pandemic was different. It affected all of us on a daily basis, in our own homes, in our places of work. We were all called to respond. In a speech to the House of Commons, Prime Minister Winston Churchill, after France had fallen to the Nazis, after 300,000 British soldiers were evacuated from Dunkirk, and as the invasion of the United Kingdom appeared imminent, spoke not of the considerable disaster that had befallen the troops. Nor did he speak of the grim prospects that faced the country. Instead, he spoke of the heroic efforts they had made in response, saying, “This was their finest hour.” I prefer to remember of our response to the Pandemic as our finest hour. Lastly, I’d like to thank Hon. Frank P. Geraci, Jr., for the great work he did as Chief United States District Judge and Hon. Paula L. Feroleto for an outstanding job as Administrative Judge of the 8 th Judicial District. Please join me in welcoming Hon. Elizabeth A. Wolford as the new Chief United States District Judge and Hon. Kevin M. Carter, our new 8th JD Administrative Judge.

The Bar Association of Erie County is pleased to announce its Board of Directors for 2021- 2022. Our Board is elected by our members in an accordance with the by-laws. In this year’s election, BAEC members elected Jill Bond, Gayle Murphy, Anne Bowling, Jamila Lee, Sharon Nosenchuck, and Stephanie Saunders to the Board. Two new members of the Nominating Committee have also been elected - Stephanie Calhoun and Ashley Lowry.Thank you to all our members who voted! At the June 15, 2021 Board of Directors meeting, the newly elected were officially sworn in by the Honorable H. Kenneth Schroeder, Jr. Hugh M. Russ, III was also sworn in as the BAEC’s 115 th President. President Russ has succeeded Oliver C. Young and will serve a one-year term. Regarding his election to the BAEC’s highest office, Russ stated, “I am honored to assume the presidency of this incredible organization. As we emerge from the pandemic, we will emphasize three initiatives: diversity and inclusion efforts, wellness programs—especially in mental health, and membership enhancements.” Our full Board of Directors roster for 2021-2022 is as follows: Officers: Hugh M. As we look forward to the 2021-2022 school year, we know that tutors are needed now more than ever. While we hope to be in person, we know that we will be there for our P.S. 18 students in whatever capacity we can. If you think you can commit to tutoring a student for one hour a week, in some form, please submit an application. We will work with tutors, students, and the school to address any questions and concerns and facilitate keeping this important program in place. Lawyers for Learning is designed to assist our community’s young people in improving their academic performance, self-esteem, and self-confidence, primarily through one-on-one tutoring. Tutoring is open to all members of the Erie County legal community, including judges, attorneys, legal secretaries, paralegals, law students, and retirees. Tutoring is a one-hour-per-week commitment. You may also sign up to tutor with other colleagues if you want to share the weekly commitment. Sessions can be held any day Monday- Friday 8:00-9:00 a.m., Monday-Thursday 4:00-5:00 p.m., or Monday-Thursday 4:30-5:30 p.m. Tutoring begins in mid-October and takes place at Buffalo School #18, 750 West Avenue in Buffalo. Erie County Bar Foundation Announces New Additions to Board of Directors The Erie County Bar Foundation is pleased to announce its 2021-2022 Officers and Board of Directors. Michael F. Perley, Senior Member at Hurwitz & Fine, P.C., has succeeded David R. Pfalzgraf, Jr., as President. Hon. Mary Giallanza Carney is now serving as Vice President. Tiffany R. Perry and Jeffrey M. Priore are the Foundation’s Treasurer and Secretary respectively. New Directors serving a three-year term are Dean Aviva Abramovsky, David E. Gutowski, Hon. Craig D. Hannah, Jesslyn A. Holbrook, Marianne Mariano, and John E. Richmond. FROM THE ERIE COUNTY BAR FOUNDATION WE’RE HERE! As we emerge from the pandemic, I can only marvel at the leadership of David Pfalzgraf over the last year. Only meeting virtually, David, as President of the Board, guided the Foundation, inspired our Board, and ensured that our colleagues in crisis received the assistance they needed. His is a tough act to follow. In May, four of our Board Members’ terms ended. Each departed, having made extraordinary contributions to the mission of the Foundation. We will miss Alan Carrel, Helen Ferraro-Zaffram, Bill Hites, and PamThibodeau. That bittersweet moment was

followed by the appointment of six new members. Yes, six. Our Board has expanded from 15 to 17, so that we can better serve our legal community in the coming years. We welcome Dean Aviva Abramovsky, Hon. Craig Hannah, Jesslyn Holbrook, David Gutowski, Marianne Mariano, and John Richmond. We look forward to their contributions. As I thought about this year, I was reminded by my friend and partner at Hurwitz & Fine, Dan Kohane, of a story involving a mutual attorney/friend who, a few years ago served as claims counsel to an insurance company. That attorney had arranged to work remotely so the family could move out of state. I happened to be at that company’s headquarters for meetings when I saw that attorney, who, looking pale walked up to me and whispered, “I just lost my job.” A new CEO had arrived and insisted that the attorney work at headquarters or be terminated. The result was devastating. As soon as I could, I phoned Dan with the news. In less than a minute, I received a copy of an email Dan sent to our colleague. It simply read: “We’re here.” In two words, Dan had quietly and eloquently offered comfort and support to a colleague in crisis. Those two words are embedded in my memory. As I considered the Foundation’s mission, I could think of no better message than this simple statement: We are here. For 64 years, the Foundation has helped attorneys in need. At first, assistance was purely financial. But, as the profession has become more stressful and complex, our areas of assistance have expanded. Our work includes confidentially helping attorneys with mental health issues, substance use disorders, inability to work due to illness, family issues, or who are otherwise in need. Over the past two years, the Foundation has spent over $500,000 to ensure that attorneys in need received proper care and their families would havehad access to the basic necessities of life. To all, our message is the same one Dan wrote to a colleague in crisis years ago, except our message is no longer quiet. Simply stated, “WE’RE HERE!”
