Letter from the President

I have read these President’s letters over the years. It is always so interesting to me to hear someone else’s stories, perspectives, and insights. I never considered that someday, I might be the one writing this letter. To be honest, I have never thought of my story as particularly interesting, nor my perspectives as especially insightful, yet I find myself tasked with sharing both in the next four installments of this Bulletin. It is an honor to serve you Over the past 35 years “or so,” I have had the privilege to practice in a profession I love and to interact with many of the members of this Association both professionally and socially. Some of the best people I know are the lawyers practicing law in this community. As an in-house attorney, I have handled many matters on my own, and I have also been the consumer of legal services. I have dealt with attorneys around the world. I have come to know that the attorneys in Western New York are as good as any I have worked with, even those big city big firms with sub-specialties in every practice area. I have a preference for working with local attorneys and not just because local hourly rates are much more reasonable than those big city rates! I have also worked with many lawyers on the not-for- profit boards on which I have served over the years. These attorneys have always been ready to pitch in when the hard work needs to be done to address the many needs of our community. I have come to admire and respect many of you, and those whom I have not had the pleasure to meet, I also admire and respect as I know the intellect and hard work this profession requires. To be selected by this Association to serve as a leader for this year is the honor and privilege of my career. I am prepared to serve you I served as a Director of BAEC some time ago and enjoyed getting to know how the Association works and the issues addressed. Serving on the Board and on the Judiciary Committee were both terrific experiences. I got to know attorneys I might not otherwise have met and I observed and understood the important work of this Association. This past year as Vice President taught me so much more. I have to thank Past President Hugh Russ, who included me in every decision that was made, soliciting and listening to my thoughts, even if, and maybe especially if, his inclinations differed from mine. I thank Hugh for this and for serving as a role model for me. He gave so much to this Association during his presidency. He went out on limbs more than once, shared his story of privilege and struggle to understand and support those who of us who do not enjoy such advantages. He had countless meetings with people of color in our community, and those conversations informed

6 | July/August 2022 | BAEC Bulletin his decision making. He pushed for the Member Assistance Program so that all of us would have access to care when mental health and substance use disorder arise. I learned a lot from watching his thoughtful, steady and servant leadership. I will be a better leader because of our time together. What brought me to your service Sometimes, when something big happens, I am struck by how many things had to happen in a very precise way to allow for the incident to occur. How leaving the house just a minute earlier or taking a different route could lead to an accident or the avoidance of one. I guess the election that made me your President makes me ponder the same: What major and seemingly minor occurrences led me to be in this position at this time? For my sixth grade graduation, I had to list what “I wanted to be someday.” I wrote that I wanted to be a lawyer. Yet, as I was about to graduate from Canisius College, I was heading toward a career in social work. When I approached my favorite professor, Dr. Jesse Nash, to ask him if he would write a letter of recommendation for a MSW program, he pulled me into his office and, spent the next hour convincing me to apply to law school instead. In an hour, he resurrected my dream of a career in law. I often wonder how different my life would be if he hadn’t given me the gift of his time and belief that I could accomplish not just what I dared to dream, but so much more. What if my first job in law had not been in corporate law? I wouldn’t have gotten the job at Rich Products, which has been my home for almost 35 years. If not for the pandemic, I would have been concerned that my business travel would make serving as President impossible. I have been asked why I would want to serve as president. Obviously, it is a big commitment. As an in-house lawyer, I won’t get more business, and I am not looking for another job at this point in my career. I never thought of it that way. When asked to serve, I believe that if you have the ability to do so, you step up. If I can contribute to the success of this association and its members, I want to do all I can to do just that. How will I serve you Whatever circumstances, life choices and experiences have put me here in this position and time, I am called upon to decide how I will serve this organization these twelve months. The pandemic has changed how people work and interact. As an organization committed to serving its members, I believe this is an ideal time to assess what our members want and need

from us. We will listen to you and develop plans based on what we learn. I also will study how the hybrid and remote work of today may adversely impact women. Access and visibility are key to advancement. With more women opting to work remotely as they continue to integrate their work life with their responsibilities outside of work, it stands to reason that women may lose some of the ground they have gained toward that ever-evasive parity we strive to achieve. The BAEC will also audit all of our programs and offerings to make sure they are consistent with our diversity, equity and inclusion goals. We will also continue our work on attorney wellness, as the pandemic has left us more fragile, depressed, anxious and reliant on unhealthy substances. The priorities are many, the goals are lofty. But I have the most amazing Board and Committee Leadership to help me march forward, and a terrific BAEC staff led by Anne Noble, to help me along the way. These are my plans. But we all know that things happen that we never planned for. I know we will together rise to whatever challenges comes our way this next year. Enjoy the Beautiful Buffalo summer with those you love and stay safe. I welcome your feedback as I serve. I know that diverse perspectives help in making the best decisions. With sincere gratitude for the people and both the good and bad experiences that have resulted in my being ready for this challenge as well as your support in electing me as President,

8 | July/August 2022 | BAEC Bulletin EIL Dean Hugh M Russ Launches New Year With Emphasis on Racial Justice and Inclusion Education

Dear Members,

President Jill Bond has appointed me to serve as Dean of the Erie Institute of Law, and I am excited to assume this new role. As you know, the EIL constitutes the educational arm of the BAEC. I am honored to work with the BAEC board and staff to bring our valuable CLE curriculum to our members cost effectively. During the pandemic, we learned that our committees and CLEs were often the only connections our members had with the legal community. Members have suggested, however, that, as we have emerged from our two year struggle, our curriculum needs to be refreshed and updated. During my year as President, I

made it one of my highest priorities to stress racial justice. We learned about white privilege and structural racism. We realized that considerable work remains to have our community embrace diversity, foster equity, and promote inclusion. The events of May 14 only serve to emphasize the work that remains. Education is one critical way to combat racism and to keep all of us committed to establishing lasting change in Buffalo. As summer ebbs, and as a new bar season flows, the EIL will launch a social justice series. We will feature five CLEs focused on diversity, equity, and inclusion. Nanette Massey, a community educator, will lead the first session on August 24, entitled “Moving Beyond ‘White Fragility’: Honest, Effective conversation about Race after May 14.” The full list of programs is included, I encourage you to join us as we continue our dialog about racial justice in the legal profession, in Buffalo, and beyond.

I am humbled and grateful to have been chosen to be the president of the Erie County Bar Foundation. Following in the footsteps of Mike Perley, I have large shoes to fill. I will continue to raise awareness about the Foundation and its incredible work. Now, more than ever, there is a need to reach out to our colleagues and let them know that there is confidential help for them. Substance use disorder, financial matters and mental health are encountered by many, and we are here to help. During my presidency, the primary focus will be on mental health. In my own practice as a juvenile defense attorney, mental illness is overwhelming and the lack of resources pitiful. Emerging from two years of isolation caused by the pandemic, along with the familial stressors, loss of wages and the pressure of helping those who come to us with their problems, leads to anxiety, stress, and frustration, which can, in turn, develop into depression. We have implemented a Members Assistance Program (MAP) which is a free service to help our members navigate this difficult time. Our board is at the ready to help you work through any of these issues. I pledge during the next year to shepherd the Foundation and promote its good works so it remains the vital resource our community has depended on for so many years. •
